Ignition Interlock Device Laws
- DUI laws in Nevada state that all DUI offenders may apply for reinstated driving privileges after they are subjected to a court-ordered license suspension.
- All offenders with three or more convictions must install an ignition interlock device in any vehicle they own or drive in order to qualify for reinstated privileges.
- First and second-time offenders are not automatically required to install an interlock device, but a device may be ordered at the court’s discretion.
License Suspension
Administrative Suspension
In Nevada, drivers face an immediate administrative suspension if they are stopped for suspicion of driving under the influence and either fail or refuse to take a field sobriety test.
If not successfully challenged within seven days of the arrest, this suspension lasts for a period of 90 days.
Judicial Suspension
In addition to administrative suspensions, offenders are also subject to court-ordered suspensions if they are convicted of driving with a BAC of .08% or greater.
Suspension periods are 90 days for a first offense, one year for a second offense, and three years for third and fourth offenses.
