Kansas Ignition Interlock Device Laws

  • Kansas ignition interlock laws requires devices for all convicted DUI offenders after the first offense.
    Suspensions for first-time offenders include a 30-day total suspension during which no driving is allowed and a 330-day restricted period.
  • Second through fourth offenses bring a one-year suspension followed by a one-year interlock period.
  • Fifth offenses result in permanent license revocation

License Suspension

Administrative Suspension

In Kansas, you can be charged with DUI if you drive with a BAC of .08% or above. A driver who is stopped for suspicion of DUI will be subject to an automatic administrative license suspension if he or she fails or refuses to take a field breathalyzer test.

Judicial Suspension

Drivers convicted of DUI by a court are also subject to an additional court-ordered license suspension, as well as jail time, fines, and other court-imposed penalties.

DUI Penalties and Fees in Kansas

1st Offense Fine: $500 to $1,000
Jail Time: 48 hours
Period of License Suspension: 30 days
2nd Offense Fine: $1,000 to $1,500
Jail Time: 90 days to 1 year
Period of License Suspension: 1 year (followed by 1 year with ignition interlock device)
3rd Offense Fine: $1,500 to $2,500
Jail Time: 90 days to 1 year
Period of License Suspension: 1 year (followed by 1 year with ignition interlock device)
4th Offense Fine: $2,500
Jail Time: 90 days to 1 year
Period of License Suspension: 1 year (followed by 1 year with ignition interlock device)
Possible Additional Penalties Repeat offenders may also be required to undergo drug and alcohol abuse assessment and to complete a treatment program for substance abuse.
