Ignition Interlock Device Laws
- Florida courts may order that ignition interlock devices be installed on any vehicle operated by convicted DUI offenders.
- In the case of a first offense, the period of time during which the interlock device must be installed is at the discretion of the court.
- If the driver’s BAC was .15% or higher, or if there was a minor in the car, the interlock device period is at least six months.
- For a repeat offense, the ignition interlock must be installed for a period between one and five years according to Florida ignition interlock device laws.
License Suspension
Administrative Suspension
In Florida, a driver who is stopped for suspicion of DUI and who refuses or fails a field breathalyzer test with a BAC of .08% or higher is subject to automatic license suspension.
The suspension is effective immediately, and the arresting officer will issue a 10-day driving permit.
If the driver does not contest the suspension within 10 days, the suspension will go into effect for six months from the date of the offense.
Judicial Suspension
Upon conviction or the establishment of a plea agreement for DUI, offenders face court-ordered license suspensions of between 180 days and 10 years. Offenders who have been convicted four times face permanent license revocation. The DUI laws state that offenders also face the possibility of fines and jail time for all convictions.
